Varying the terms of a long lease

If you wish to agree to change the terms of a lease, then you will need a deed of variation.

These can be used to change the terms of a lease, for example by:

• extending the term;
• allowing pets when they were previously prohibited;
• amending access or a right of way.

Occasionally, a deed of variation may be used to change how property is passed under the terms of a will after the person who wrote it has died. For example, a property may be passed directly to grandchildren if it is not needed by their parents.

The new deed must have the agreement of all concerned, including any lender, and in all circumstances, it is important to seek expert legal advice.
